Terms and Conditions for the use of Dedicated.to
1. The current rules of use of the website Dedicated.to (past and present) were developed by the site's administration and define the conditions for the use and the development of the site as well as the rights and responsibilities of both its users and administration. The rules also extend to the rights and interests of third-parties who are not users of the site, but whose rights and interests are perhaps affected by the results of actions taken by the site's users.
2. The present rules provide a legally binding agreement between the users and administrations of the site. The accordance of the site's administrations towards any user who uses the facilities provided by the site and it’s services (taken further: its facilities) is a subject of this legally binding agreement.
3. A user has to get completely aquainted with these regulations before the registration. If the user is registered that means Regulations are accepted.
4. These REgulations may be updated by Administrators without any notice. Users are advised to monitor this page regularly. If the user is registered that means any changes without notifications are accepted.
Prohibited Use of the Site
1. By using the Site, you confirm that you fully recognize that the materials which you upload to the Site or with the Site may potentially violate the property and/or personal non-material rights of third parties protected by law, including, without limitation, the exclusive rights to intellectual property and/or may contain information which it is not permitted to disseminate by the laws of the Russian Federation.
2. The following is PROHIBITED on this SITE in accordance with these Regulations:
  1. To collect or amass e-mail addresses or other contact information of the 'Site's' users either by automatic means or in any other way in order to distribute non-requested messages (spam) or other unwanted information;
  2. To use the Site in any way that could interfere with the normal functioning of the Site and its services;
  3. To use automated scripts (programs) to collect information and/or interact with the Site and/or its services;
  4. To download, publish, transfer, or in any other way distribute ('Disclose') any information which contains threats, discredits or offends other users or third parties, is vulgar, obscene or fraudulent, infringes on personal or public interests, propagates racial, religious, or ethnic hatred or hostility, or any other information which breaches the human rights and rights of citizens as set forth by law;
  5. To distribute any commercial advertisement, commercial offer, campaign materials, distribute spam, chain mail letters, financial pyramid schemes, or calls to participate in them, or any other obtrusive information with the exception of those cases when the placement of such information was approved by an Administrator;
  6. To upload any files which contain or may contain viruses or other harmful programs;
  7. To describe or propagate criminal activities and/or place instructions or administer criminal actions;
  8. To attempt to receive access to someone else's account against the will of that person in any way, including, without limitation, by hacking;
  9. To place any information which breaches the exclusive rights of users or third parties to intellectual property;
  10. To place any information which, in the opinion of an Administrator, is unwanted, does not conform to the purposes of use of the Site, infringes on users' interests, or for any other reason is unwanted for the Site.
3. Administrators reserve the right at their discretion to change (moderate) or delete any information which you publish which violates Section 2.2 of the Regulations, to suspend, limit, or terminate your access to any and/or all services on the Site at any time and for any reason without explanation and with or without prior notification as such without being liable for any harm that my be caused due to said actions;
4. Administrators are entitled to delete your account and/or terminate, limit, or suspend your access to any services on the Site if an Administrator discovers that, in his/her opinion you are a threat to the Site and/or its users.
Exclusive Rights to the Site Content
1. All objects on the Site including elements of design, text, graphics, illustrations, video, scripts, programs, music, sounds and any other objects or their parts (the Content) are the exclusive property of the Administrators, the users on the Site, and other right holders whose rights to said property are protected;
2. With the exception of those cases set forth herein and/or in the legislation of the USA, no Content may be copied (reproduced), remade, disseminated, reflected in a frame, published, saved, transferred, sold, or in any other way used in full or in part without preliminary permission from the right holder with the exception of those cases when the right holder has explicitly expressed his/her/its consent to the free use of such material by any entity;
3. By placing your Content on the Site, you are providing other users with the non-exclusive rights to use it by viewing it, reproducing it (including, without limitation, by copying it), processing it (including, without limitation, by printing copies), and other rights exclusively for personal, non-commercial use with the exception of those cases when such use harms and/or may cause harm to the right holder's legally protected interests;
4. Use of the Content to which you have received access exclusively for your personal, non-commercial use is permitted provided that all signs of its author (copyrights) or other notifications on its author are preserved keeping the name of the author and the product unedited;
5. With the exception of your own personal Content, you are not entitled to download or in any other way disseminate (publish on the Site) the Content of other sites, databases, and/or other exclusive property unless explicit consent is given by the right holder to such actions;
6. Any use of the Site or the Content besides that permitted herein or expressly consented to by the author (right holder) to such use without prior written permission from the right holder is expressly prohibited;
7. If a well-reasoned complaint is received from a right holder on a breach of its legally protected rights, the Administrators reserve the right to apply all measures to the offender set forth in Section 2.3 of the Regulations;
8. Unless expressly provided for otherwise herein, nothing in these Regulations may be deemed a transfer of exclusive rights.
Liability for a Breach of Exclusive Rights
1. You are full liable for any Content or any other information that you upload or in any other way disseminate (publish) on the Site or using the Site. You may not upload, transfer, or publish Content on the Site if you did not create it personally or if you have not received permission from the right holder;
2. You understand and agree that the Administrators may but are not obliged to review the Site for prohibited Content and may delete or move any Content (without warning) or users at their own discretion for any reason and/or without reason including, without limitation, moving or deleting Content which, in the personal opinion of the Administrators is in violation of these Regulations or may be illegal or in breach of rights and/or may cause harm or threat the safety of other users and/or third parties;
3. You are fully and personally liable for saving the Content (creating reserve files) which you upload or save to the Site;
4. By uploading your Content to the Site, you are authorizing the Administration to make copies of your Content in order to order and ease publication and/or storage of user Content on the Site;
5. By uploading your Content to any part of the Site, you are automatically providing the Administrators with the non-exclusive rights to use it by copying it, publicly performing, reproducing, processing, transferring and/or disseminating it for the purposes of the Site and/or in connection therewith for its popularization. For these purposes, the Administrators may prepare derivative works or place your Content as components to collections, and/or take any other actions which serve reaching these goals;
6. If you decide to delete your Content, the rights set forth in Section 4.5 hereof will automatically be retracted; however, it should be noted that the Administrators may save archived copies of user Content.
Third Party Sites and Content
1. The Site contains (or may contain) links to external websites (third party websites) and/or articles, photos, graphics, pictures, music, audio, videos, information, and other Content owned or uploaded by third parties (third party Content);
2. These third parties and their Content is not checked by Administrators for its conformity with requirements (accuracy, completeness, integrity, etc.). The Administrators are not liable for any information on third party sites to which you received access through the Site or through third party Content including, without limitation, any opinions or approval expressed on third party sites and/or in their Content.
3. Links on the Site or instructions on saving files and/or installing programs of third parties do not mean that the Administrators support or approve of these actions.
4. Links to any site, product, services, and commercial and/or non-commercial information on the Site do not represent the approval of or recommendation of these products (or services) by the Administrators;
5. If you decide to leave the Site and go to third party sites or use or install third party programs, you are doing this at your own risk and from this point on these Regulations are no longer valid. In your further relations, you should be governed by the applicable norms and policy, including, without limitation the normal course of business of those entities whose Content you are using.
User and Administrator Liability
1. You are fully liable for the Content you place on the Site, any information sent to other users, and your relations with other users;
2. Content uploaded by users is not subject to mandatory verification by Administrators before its publication (pre-moderation) and does not necessarily reflect the opinion of the Administrators on any issues. The Administrators do not give any warranties, either clearly stated or presupposed, in relation to any Content, its validity, truthfulness, or accuracy;
3. As the Site is open for general access and is not a pre-moderated information resource, the Administrators are not liable in any way for any Content of users or third parties uploaded to the Site or with the Site;
4. Administrators are not liable for any behavior of users or third parties using or viewing the Site either online or offline;
5. The Site or its services may be at a certain time partially or fully unavailable due to prophylactic or other work or for any other technical reasons. The Administrators are entitled to perform the required prophylactic or other work at any time as they see fit with preliminary consent to the users or without such consent;
6. The Administrators are not liable for any mistakes, omissions, interruptions, deletions, defects, delays, and /or transfers of information, connection time-outs, theft, destruction, or illegal access to user materials placed on the Site or any other place. Limitations to the Liability of the Administrators

3. 4. The Administrators reserve the right to change the form of the Site, its Content, the list of services, to change or add scripts, software, and other objects used or saved on the Site, any service applications at any time with or without preliminary notification at any time;
5. The Site Administration does not in any case hold liable to you or to third parties for any indirect, accidental, or inadvertent harm including, without limitation lost profits or lost information, loss of reputation, dignity, or business reputation incurred as a result of using the Site, the Site contents or any other materials to which you or other entities received access using the Site even if the Administrators warned or stated the possibility of such harm.
Final Provisions
1. These Regulations are an agreement between you and the Administrators regarding the method for using the Site and its services and replaces all preceeding agreements between you and the Administrators;
2. This Agreement is governed and interpreted in accordance with the legislation of the USA. Issues not regulated by the Agreement shall be settled in accordance with the legislation of the USA.
3. Should any dispute or disagreement arise with regard to the way in which these Regulations have been carried out, the user and administrators should apply full effort in resolving the dispute through negotiations. Should the dispute fail to be resolved through negotiations, it will be resolved in a way as determined by the functioning legislation of the USA.
4. These Regulations are effective from the moment the user agrees to them and are valid indefinitely.
5. If for any reason one or more of the regulations hereof is acknowledged to be invalid or not legally binding, then this shall not affect the validity or applicability for any of the remaining regulations.
